Waiver of Liability Agreement for Volunteers of Pauly's Project

This Waiver of Liability Agreement ("Agreement") is entered into by and between:

• Pauly's Project, a nonprofit organization located at 843 E. Edna Place, Covina, CA 91723 or other volunteer locations (the “Organization”), and

• An individual volunteer (the "Volunteer").

By signing this Agreement, the Volunteer agrees to the following terms and conditions:

1. Voluntary Participation

The Volunteer acknowledges that their participation in any activities, events, or programs organized by Pauly's Project, including street outreach, food distribution, warehouse management, or any other volunteer services (the "Activities"), is entirely voluntary.

2. Assumption of Risk

The Volunteer understands and accepts that participation in the Activities may involve certain risks, including but not limited to physical injury, illness, property damage, or other unforeseen events. The Volunteer assumes full responsibility for any such risks arising from participation in these Activities, whether foreseen or unforeseen, and voluntarily participates with full knowledge of the risks involved.

3. Release of Liability

The Volunteer agrees to release and discharge Pauly's Project, its officers, directors, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action that may arise from any injuries, damages, or losses incurred as a result of participation in the Activities. This release of liability extends to injuries or damages caused by the negligence of Pauly's Project or any of its representatives, except in the case of gross negligence or intentional misconduct.

4. Indemnification

The Volunteer agrees to indemnify and hold harmless Pauly's Project from any claims, damages, or legal fees arising from the Volunteer’s actions during their participation in the Activities. This includes any claims brought by third parties due to the Volunteer’s conduct.

5. Medical Treatment

In the event of any injury or illness during the course of participation in the Activities, the Volunteer authorizes Pauly's Project to seek any necessary medical treatment on their behalf. The Volunteer agrees to bear any costs associated with such treatment and understands that Pauly's Project is not responsible for any medical expenses incurred.

6. Duration

This waiver shall remain in effect for an ongoing period of time starting from the date of the Volunteer’s signature below. It will apply to all future volunteer activities with Pauly's Project until the Volunteer revokes the waiver in writing or ceases to participate in the Activities. The Volunteer may specify the duration or termination of this waiver by providing written notice to Pauly's Project.

7. Photographs and Media Release

The Volunteer grants permission for Pauly's Project to take photographs or videos of the Volunteer during the Activities and to use these images for promotional, educational, or fundraising purposes without further compensation or notice.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any legal disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of California.

Acknowledgment of Understanding

The Volunteer has read this Agreement, fully understands its terms, and signs it voluntarily. The Volunteer acknowledges that they are giving up substantial rights by signing it, including the right to sue Pauly's Project.
